Booking contract

These terms and conditions (the “Booking Agreement”) are binding on the owner or manager of the property (“owner” or “manager”) and travelers who book the property (“the property”) through our website www.tenutailcavaliereditalia.com. Each such booking is referred to in the booking contract as a “booking”. Any references to “you” or “users” are intended to mean the person making the booking and all persons to whom such booking relates.

All bookings are subject to the Booking Agreement. This Booking Agreement and the confirmation email sent by the owners contain the entire agreement between users and owners and constitute the contractual documentation. We therefore recommend that you read them carefully.

No clause or provision contained in this Booking Agreement will have any effect on your rights under law

The payment facilitator used for the booking will be Tenuta il Cavaliere d'Italia SRL, a company registered in Italy

 

Booking procedure

There are two ways available to the users to make a booking viz.

Book a property through the booking request form ("booking request form") directly from the website www.tenutailcavaliereditalia.com, selecting the dates and entering the data necessary to continue the booking process. Once the booking request has been accepted by Tenuta il Cavaliere d'Italia, the bank details to make the deposit payment or full payment for the booking will be provided together with the acceptance. The cancellation terms and methods will be described in the booking acceptance email, as established by the property. Payment of the sum due must be received no later than two working days from the time of booking. After making the payment, it is advisable to send a copy of the bank statement via e-mail to wait for the banking times.

Send the property a ("quote request") through the contact form, where as soon as possible the complete quote, payment terms and cancellation methods will be sent via e-mail in response. The response to the quote request is not a booking confirmation, it will therefore be necessary to confirm the quote and ask to proceed with the booking which will be sent as acceptance only after checking the availability update at that precise moment.

 

If, through the quote or booking request, the user is asked to:

Make full payment, you will need to pay the full amount of the reservation by the due date.

Pay a sum as a deposit ("advance") followed by the payment of the balance ("balance"), it will be necessary to make both payments to Tenuta il Cavaliere d'Italia within the specified deadlines.

The user is required to pay any security deposit ("security deposit"), the fee for the cleaning service and/or any ("other fees") upon full payment or upon payment of the balance (in as specified in the confirmation email").

The user is required to carefully check all the details of the quote and the booking request form before making any payments to Tenuta il Cavaliere d'Italia SRL by virtue of the booking, to read the confirmation email in full and to immediately inform the owners in case of errors or omissions.

Payment Procedure

If the sums due as a deposit have already been paid, it will be necessary to notify Tenuta il Cavaliere d'Italia SRL via e-mail of the payment of the deposit and subsequently of the deposit. Generally, extra costs such as final cleaning, consumption and tourist taxes are asked to be paid at the time of check-in including the security deposit. In the event of failure or incomplete payment of the balance due to Tenuta il Cavaliere d'Italia SRL with respect to the agreed deadlines, the company will have the right to consider the reservation canceled by the user and the provisions established in the cancellation method will therefore be applicable (according to as defined below). The

Cancellation or modification of the reservation by the user

If it is necessary to cancel or modify the reservation, the Tenuta il Cavaliere d'Italia company must be informed in writing via e-mail in a timely manner. Cancellation or modification of the reservation will not be effective until the owners receive the confirmation sent to the user. The cancellation method described in the confirmation email (cancellation method) regulates the management of the reservation; Tenuta il Cavaliere will reimburse any amounts owed to the user in accordance with the agreed cancellation method.

In the event that:

Some amounts due as a balance were not paid within the timescales defined in the cancellation method.

The user does not show up at the property within 24 hours of the arrival date without first informing the company.

The company will have the right to treat the reservations as canceled by the user. The relevant cancellation method will therefore apply.

 

Current Cancellation Terms (“Cancellation Terms”)

30% deposit at the time of booking, guests who cancel a reservation 60 days before the check-in date will lose the amount paid (“30% deposit”).

Balance 60 days before check-in, guests who cancel a reservation from the fifty-ninth day before the check-in date will lose the amount paid (“Balance”).

Note: Cleaning fees are always refunded if the guest cancels before check-in, regardless of the cancellation policy you set.

 

Cancellation or modification of the reservation by the owner

As a rule, the company does not make changes to reservations already granted and accepted. However, problems may sometimes arise that make it necessary to modify or, more rarely, cancel a reservation.

In this case, the user will be contacted within a reasonable time and informed of the cancellation or modification of the booking. If the booking is canceled by the company, it will refund the user any amounts already paid to Tenuta il Cavaliere d'Italia Srl. However, the company declines any responsibility for reimbursement for any fees paid to third parties in relation to the holiday (including by way of example only: transport, entertainment, activity or insurance costs).

Structure

The user will be accepted at the facility starting from the time specified by the company in the indication of the arrival date and must leave the facility within the time specified by the company in the indication of the departure date. The times will be announced in writing and with due advance notice.

In case of delay in arrival, it is necessary to contact the contact person whose contact details are indicated in the booking confirmation email, in order to allow the necessary measures to be taken. In case of lack of notice, it will not be possible to access the structure. In case of failure to show up at the property by 12 noon on the day following the arrival date, in the absence of prior notification of the delay, the company reserves the right to consider the reservation as canceled by the user and will not be obliged to refund any amounts already paid by the user through Tenuta il Cavaliere d'Italia srl. Important things to know

the villas are within citrus groves, olive groves where nature is lush, they are hilly countryside areas and for this reason we would like to point out that there may be local animals, it is possible to meet some cats or dogs, field mice, foxes and similar. The villas are fenced with hedges and surrounding vegetation.

 

User obligations

You agree to act in accordance with the provisions expressed in the guide available at the property and any other provisions reasonably specified by the check-in official and to ensure compliance with the same by all persons included in the reservation . You agree to maintain and leave the property, furnishings, including items such as kitchen equipment, crockery and glassware in good condition.

You agree not to cause any damage to walls, doors, windows or other parts of the structure nor to take any action that could be considered a nuisance to the company managing the structure or any occupants of adjacent structures.

You agree to take steps necessary to protect your personal belongings during your stay at the property.

 

You agree to ensure that all persons included in your booking have travel insurance cover (covering cancellation, delay of flights, loss or damage to baggage and personal effects) and health insurance cover (covering any evacuation costs or repatriation).

 

The number of occupants of the structure must correspond exactly to the authorized number; it is forbidden to change the composition of the group during the stay. Pets are only allowed in the presence of written authorization issued by the owner before arrival. In case of failure to comply with the aforementioned rules, the owner reserves the right to deny the user access to the structure or to request immediate abandonment. In contractual terms, circumstances of this kind are similar to the procedures for canceling a reservation by the user, therefore the company will not be required to make any refund of the sums already paid. The company reserves the right to grant any refunds at its discretion.

Complaints

All necessary steps have been taken to ensure users have a fun and memorable holiday. Despite this, if users believe that there are grounds for submitting a complaint, it is essential to ensure that any corrective actions are implemented promptly.

To this end, it is essential that, in the event of problems, users contact the company in order to facilitate a rapid resolution. It is often extremely difficult (sometimes impossible) to resolve problems without timely notification. Reporting any complaints to the management company during your stay at the property usually allows problematic situations to be remedied immediately. In particular, complaints of a transitory nature (for example relating to the state of the premises or the heating in the structure) cannot receive attention in the absence of a communication during the stay at the structure.

If it is not possible to remedy a problematic condition during the holiday, it will be necessary to send the company a written communication, including via e-mail, including all the details, no later than 7 days after the end of the stay.

For the avoidance of doubt, the user is always required to contact the company directly in case of complaints relating to the booking or the property.

Limitation of Liability

The maximum liability for losses resulting from a breach of this booking agreement by the company is strictly limited to the amounts received pursuant to the booking. The management company declines all responsibility in the event of losses not foreseeably attributable to the breach of this booking contract. These are losses contemplated by the users and the owners at the time of confirming the booking.

The booking refers to the purchase of a service for tourist purposes; the user therefore agrees to indemnify the company from any liability in the event of losses of a commercial or other nature occurring to the detriment of the user.

 

Competent photo

This booking contract (including any contractual obligations emerging by virtue of the same) stipulated between users and the management company is governed by the Italian laws in force. Both parties agree to entrust exclusive jurisdiction in the event of litigation or other disputes to the competent court of Bologna Italy.
